Pay Disparity After Ledbetter: The Next Wave of Employment Litigation?
The Lilly Ledbetter Fair Pay Act, signed into law in January 2009, already has altered the regulatory and litigation landscape for employers. The looming Paycheck Fairness Act will further increase the likelihood of suits alleging discriminatory pay practices - both individual and class actions - should it be enacted as many commentators expect. This session will examine both of these laws and provide practical suggestions on what employers should be doing now to prepare for the expected onslaught of pay disparity litigation.
Unpaid Overtime Lawsuits - Why are they continuing to occur?
There seems to be no let up in the filing of lawsuits for unpaid overtime. This presentation will provide a short overview of the key provisions of the Fair Labor Standards Act. In addition, the presenter will share his top 10 reasons why unpaid overtime lawsuits are continuing to occur as well as his top 10 recommendations for employers to comply with the FLSA. This presentation will cover practical and timely information, insights and recommendations that all employers can use and implement in order to avoid an unpaid overtime claim against their company or organization.
FMLA
In late 2008 the Department of Labor issued revisions to the Family and Medical Leave Act (FMLA). The revisions became effective on January 16, 2009 and are the first changes to the FMLA since 1993. The presentation will explain the legal requirements the new FMLA imposes on employers and what policy and procedural changes employers must make to ensure compliance with the new law. Also, this presentation will explain the key changes to the FMLA and will offer compliance strategies for employers to avoid fines and penalties.
ADA
In 2008 President Bush signed the ADA Amendments Act (ADAAA) into law. The Amendments became effective January 1, 2009. As a result of the Amendments employers are facing different challenges with regard to administration of the ADA and Amendments. This presentation will explain an overview of the ADA, the substantive changes created by the new Amendments and the practical implications of the changes for employers. In addition, this presentation will offer key compliance strategies with regard to administration of the new Amendments.
Our Speakers
Susan K. McKenna is a Partner in the Orlando, Florida, office of Jackson Lewis LLP. She is a Martindale-Hubbell "AV" rated attorney, has been selected by her peers for inclusion in the publications The Best Lawyers in America, Labor and Employment Law, Leading Florida Attorneys, Chambers USA’s Best Lawyers for Business and Florida Super Lawyers. She also has been recognized repeatedly as distinguished in her field in local publications such as “Florida Trend” magazine, “Orlando Magazine” and “Orlando Business Journal.”
Ms. McKenna's practice encompasses three primary areas of concentration. (1) Representing employers in federal and state courts and before administrative agencies. Ms. McKenna’s litigation experience includes Title VII, Age Discrimination in Employment Act, Equal Pay Act, Americans with Disabilities Act, Family and Medical Leave Act and Fair Labor Standards Act federal court litigation, in addition to state discrimination, tort and contract suits arising from the employment relationship. (2) Counseling human resources professionals and in-house counsel on workplace related issues and strategies, including drafting executive employment agreements and personnel policies. (3) Conducting training on effective supervisory techniques, workplace law developments and staying union-free.
John Finnigan owns and operates the Finnigan Law Firm which specializes in employment and labor law. The firm handles all areas of employment and labor law in federal and state court litigation and in various employment related administrative agencies. Prior to starting his own law firm on March 1, 2007, John worked in large law firms where he gained extensive experience in employment and labor law. John is Board Certified by the Florida Bar in Employment and Labor law, has been selected in Best Lawyers in America, and has been recognized as among the best lawyers in employment and labor law in Central Florida by the “Orlando Business Journal” and “Orlando Magazine.”
Aaron Zandy is a board certified specialist in Labor and Employment law, represents private and public sector employers in all areas of traditional labor and employment law. His practice encompasses all areas relating to the counseling and representation of management clients in federal and state courts, as well as before federal, state, and local administrative agencies. As a certified Senior Professional in Human Resources (SPHR), he provides proactive counseling and legal advice to employers and management regarding human resource issues and related statutory and regulatory compliance. Aaron has extensive experience providing management education on legal trends, judicial developments, human resource practices, and statutory and regulatory compliance to various national, state, and local trade, civic, not for profit, and professional organizations.
Aaron is a member of the American Bar Association, Labor and Employment and Litigation Sections; the Florida Bar Association, Labor and Employment Section; and the Orange County Bar Association, Labor and Employment Section. He is also a member of the National Society for Human Resource Management (SHRM), the Central Florida Human Resource Association (CFHRA) and the North Central Florida Society for Human Resource Management (NCF-SHRM) chapters. He is a graduate of Leadership Winter Park, Class 16.
